These Terms of Service (ToS) govern the use of the GasyWay platform, a booking service for travel and tourism experiences in Madagascar.

2. Definitions

  • Platform: The GasyWay website and application
  • User: Any person using the platform
  • Traveler: User making a booking
  • Partner: Tourism service provider
  • Pack: Travel offer or experience proposed

3. Access and Use of the Platform

3.1 Access Conditions

Access to GasyWay is free for consultation. Some features require the creation of a user account.

3.2 Account Creation

  • You must be at least 18 years old
  • The information provided must be accurate and up-to-date
  • You are responsible for the confidentiality of your credentials

3.3 Authorized Use

You agree to use the platform in accordance with applicable laws and these Terms. The following are prohibited:

  • Unauthorized commercial use
  • Distribution of illegal or inappropriate content
  • Hacking or intrusion attempts
  • Identity theft

4. Proposed Services

4.1 Booking Services

GasyWay connects travelers and tourism service providers in Madagascar. We facilitate bookings but do not own the proposed services.

4.2 Intermediary Role

GasyWay acts as an intermediary. Tourism services are provided by our partners under their sole responsibility.

5. Bookings and Payments

5.1 Booking Process

  • Selection of the desired pack or service
  • Real-time availability check
  • Entry of traveler information
  • Secure payment and immediate confirmation
  • Receipt of confirmation by email and SMS
  • Automatic transmission to the local partner

5.2 Prices and Payment Methods

Prices are displayed in Malagasy Ariary (MGA) including all taxes. They include Malagasy VAT and GasyWay service fees. Prices may vary according to:

  • Tourism season (high/low season)
  • Group size
  • Selected optional services
  • Exchange rate fluctuations (for international services)

Accepted payment methods: International bank cards (Visa, Mastercard), PayPal, bank transfer for groups.

5.3 Confirmation and Travel Documents

Your booking becomes final after:

  • Receipt of payment
  • Confirmation of availability by the partner
  • Issuance of the electronic voucher

You will receive a travel file containing all necessary documents (vouchers, local contacts, recommendations, weather conditions) within 24 hours.

5.4 Booking Modifications

Modifications are possible subject to availability and may incur additional fees. Requests must be made at least 48 hours before the scheduled date.

6. Cancellations and Refunds

6.1 Standard Cancellation Scale

Cancellation fees according to deadline:

  • More than 30 days: Full refund (except 5% service fee)
  • 15 to 30 days: 25% cancellation fee
  • 7 to 14 days: 50% cancellation fee
  • 3 to 6 days: 75% cancellation fee
  • Less than 72h or no-show: 100% cancellation fee

Some packs (boat crossings, special accommodations) may have specific conditions mentioned at booking.

6.2 Recommended Travel Insurance

We strongly recommend subscribing to travel insurance covering:

  • Cancellation for medical reasons
  • Trip interruption
  • Medical repatriation
  • Loss/theft of luggage
  • Medical expenses abroad

6.3 Force Majeure and Exceptional Conditions

In case of unforeseeable events affecting Madagascar:

  • Tropical cyclones: Free postponement or full refund
  • Political/security unrest: Refund or credit valid for 2 years
  • Pandemic/sanitary restrictions: Special conditions depending on the situation
  • Transport strikes: Free postponement or alternative solution

6.4 Refund Procedure

Refunds are made to the initial payment method within 14 business days after acceptance of the cancellation request.

6bis. Specific Conditions for Travel in Madagascar

6bis.1 Seasons and Climate

Madagascar has two distinct seasons that can affect certain activities:

  • Dry season (April-October): Optimal conditions, all sites accessible
  • Rainy season (November-March): Some tracks may be impassable

We systematically inform you of road conditions and adapt itineraries if necessary.

6bis.2 Wildlife Observation

Wildlife observation depends on natural factors. Although our guides are experienced, we do not guarantee the sighting of specific species (lemurs, whales, etc.).

6bis.3 Accommodation Standards

Malagasy hotel standards may differ from international standards. Our partners are selected for their quality of service and their ecological commitment, some accommodations prioritizing authenticity over modern luxury.

6bis.4 Entry Formalities

It is your responsibility to check:

  • Passport validity (6 months minimum)
  • Tourist visa (mandatory for most nationalities)
  • Recommended vaccinations
  • Sanitary entry conditions

GasyWay provides indicative information but cannot be held responsible for refusal of entry into Malagasy territory.

7. Responsibilities

7.1 GasyWay Responsibilities

As a travel intermediary, GasyWay commits to:

  • Select reliable and certified partners
  • Faithfully transmit your bookings
  • Provide customer support before, during, and after the trip
  • Intervene in case of problems with a provider
  • Respect pricing and contractual commitments

Liability limits: Our liability is limited to the amount of booked services. We are not responsible for services directly provided by our partners (guides, carriers, hosts).

7.2 Local Partner Responsibilities

Providers (guides, hotels, carriers) are responsible for:

  • The quality and safety of their services
  • Compliance with local and international standards
  • Subscription to appropriate professional insurance
  • Training and certification of their staff

7.3 Traveler Responsibilities

As a traveler, you are responsible for:

  • The validity of your travel documents
  • Compliance with safety instructions
  • Subscription to appropriate travel insurance
  • The accuracy of the information provided
  • Compliance with Malagasy laws and customs
  • Protection of the environment and biodiversity

7.4 Liability Exclusions

⚠️ GasyWay cannot be held responsible for:

  • Weather conditions and natural phenomena
  • Government decisions or social unrest
  • Strikes, breakdowns, or transport delays
  • Theft, loss, or damage to personal property
  • Accidents or health problems (compulsory insurance)
  • Non-compliance with formalities by the traveler
  • Itinerary modifications for safety reasons

7.5 Professional Civil Liability Insurance

GasyWay has professional civil liability insurance covering our activity as a travel intermediary. References for this insurance are available upon request.

8. Intellectual Property

All elements of the GasyWay platform (texts, images, logos, graphics, software) are protected by intellectual property rights. Any unauthorized reproduction is prohibited.

Users grant GasyWay the right to use the content they publish (reviews, photos) for promotional purposes.

9. Personal Data Protection

Personal data processing is governed by our .

In accordance with GDPR, you have rights over your data (access, rectification, deletion, portability).

10. Modification of Terms

GasyWay reserves the right to modify these Terms at any time. Users will be informed of modifications by email or notification on the platform.

Continued use of the platform after modification constitutes acceptance of the new conditions.

11. Applicable Law and Jurisdiction

These Terms are governed by Malagasy law. In case of dispute, the courts of Antananarivo shall have exclusive jurisdiction, unless otherwise provided by law.
